TAMS is a platform designed to help organizations develop, monitor, and strengthen workforce capability. Through structured learning and development journeys, TAMS provides tools for talent assessment, skill tracking, and career mapping, enabling individuals, teams, and organizations to grow with greater confidence and consistency.

2. Eligibility and Authorized Use

• Corporate Users: Organizations utilizing TAMS must be legally registered entities. The organization is responsible for managing the access levels of its administrators and employees.
• Employee Users: You must be an authorized employee, contractor, or affiliate of an organization that has subscribed to TAMS.
• Account Security: Users are responsible for maintaining the confidentiality of their login credentials. Account sharing is strictly prohibited.

3. Accuracy of Data and Assessments

The integrity of the talent assessment and development system relies on honest and accurate input.

• You agree to provide true, accurate, and complete information regarding your skills, assessments, training progress, and professional background.
• TAMS and your employing organization reserve the right to suspend any account found to contain fraudulent credentials, falsified assessment results, or misrepresented achievements.

4. Personal Data & PDPA Compliance

As a talent management platform, we process "Personal Data" and potentially "Sensitive Personal Data" in accordance with the Malaysian Personal Data Protection Act (PDPA) 2010.

• Data Controller vs. Processor: For the purposes of PDPA, your employer generally acts as the Data User (Controller), and TAMS acts as the Data Processor.
• Data Usage: Your data will be used to generate personal learning journeys, skill assessments, insights, and organizational reports for your employer.
• Third-Party Sharing: Your personal and assessment data will not be shared with external third parties without explicit consent, except as required by law or as directed by your employer (the primary account holder).
• Data Retention: We will retain your profile and assessment data for as long as your employer maintains an active subscription with TAMS, or as long as necessary to fulfill the operational and legal purposes for which it was collected.

5. Ownership of Content and Intellectual Property

• User/Company Content: You and/or your employer retain ownership of the original data, internal documents, and proprietary materials uploaded to the platform. You grant TAMS a license to host and process this data strictly to provide the platform's services and for anonymized, aggregated analytical purposes.
• Platform Content: The underlying algorithms, assessment frameworks, learning journey structures, analytics models, and the website interface remain the exclusive intellectual property of TAMS.

6. Prohibited Conduct

Users of TAMS shall not:

• Create fraudulent employee profiles, impersonate colleagues, or falsify assessment outcomes.
• Upload malware, viruses, or attempt to scrape, breach, or compromise the data of other users or organizations on the platform.
• Upload or share highly confidential or trade-secret information of their employer unless explicitly required by their organization’s use of the platform.
• Use the platform for any purpose other than its intended human resources, talent development, and educational scope.

7. Limitation of Liability

TAMS provides software tools and structured frameworks to assist organizations in workforce development. However, we do not guarantee specific business outcomes, employee retention, promotions, or performance improvements based solely on the usage of the platform. All employment, compensation, and structural decisions made by the organization remain their sole responsibility. TAMS shall not be liable for any indirect, incidental, or consequential damages arising from the use or inability to use the platform.

8. Governing Law

These Terms and Conditions are governed by and construed in accordance with the Laws of Malaysia. Any disputes arising from the use of TAMS will be subject to the exclusive jurisdiction of the courts of Malaysia.
